So then, 12 year old girl goes to meet a 31 year old of her own free will, then flies off with him showing no signs of resistence or trying to struggle, so why is he up on a kidnapping charge?

Just been following this story on the news recently with a bit of a confused reaction, fair enough, I don’t for one minute think that it’s right for anybody his age to be with anybody her age, but jesus christ, the main thing that’s puzzling me is her..she’s 12? Are they sure? She looks like a 40 year old witch!

Of course, if her parents had been paying more attention to what she’d been doing it might never have got this far. I’m all for giving kids a bit of freedom at 12 they still need a bit of parental guidance.

I could imagine being a lonely 12 year old who keeps themselves to themselves (her teacher’s description of her on a tv interview - hard working but likes to work by herself, independant, not many close friends), whose parents happily let her do her own thing on a computer for hours at a time without engaging her in conversation. It would definately make me more likely to be open to suggestions from some guy who leads an exciting life paying me a bit of attention. Hell, I was that kind of kid!

On the surface though, it does seem that she wasn’t totally innocent in all this. And on the details that have been presented already, I don’t think the guy should be facing kidnap charges because she did seem to go of her own accord.

Strange as it may seem, in UK law, whether the child consents isn’t relevant (I’ve just been reading the paper!)If the person doing the abducting has no right to take the kid, then it doesn’t matter whether s/he consents or not - it’s still abduction.

If convicted (highly likely in my opinion) he could get up to 7 years. Mind you, at least he’ll get a fair trial, unlike those at Guantanamo Bay…
