legal advice…

well heres the story…
last month I recorded with my band.We did a new E.P, and the last few days Ive found they have been trying to push me out.Certain things have cropped up and i confronted them last nite.Apparently Im too heavy metal for them and I have too much of a rock’n’roll attitude.I like playing fast and complicated, whereas they dont…and that they didnt like some of the stuff I played…
so…

Firstly I’d like to stop the record from being released.I dont want to give my permission for them to use it,seen as they have crossed the linein my opinion and secondly, can I claim anything if they do realease it, or anything they re-record…?

I don’t really know about the legalities too much but I would assume that if you contributed to the record either financially or musically then anything they make off the back of it you are entitled to a share…

We got given the money for the 2nd recording…I wrote all the drum parts and helped with the guitar parts…We were meant to be touring with MONO in may and releasing this 1 through a small indie label…Not sure what to do.Spoke to my friend that runs the label and he said they would be hard pushed to find another drummer that would be able to do the same stuff, and that he wouldnt be putting the record out or arranging the tour for the band.
If someone says they’re not happy with what I did, then I dont think they deserve to put this out, or get anything out of what I put in…

I did music Law at uni, so as far as i can see I don’t think you can stop them from releasing it but as you play on it then you are entitled to money for each machanical copy made and sold depending on what contract you have with them because as far as that record goes you were part of the band. If you have a writing credit then as long as you have submitted your form to PRS or whoever then you can get money through them for royaltys. And if you paid for the recording then you have a better chance of stopping it as you own the copyright, or depending on the contract that you have with the label fellow band mates and so on. So they can buy you out but the end of the day with music law most things have to go to court to get somewhere and it’s all down to a jury.

For playing on the record the label will pay you for each copy sold as you are part of the band on that album so sales money will come through them once and expensies have been paid off.
For things like writing credits and getting money from the cd’s getting made you have to join PRS and straight away joins you to MCPS which are the same thing to an extent and it costs 100 pounds and they pay out twice a year also joining a publishing company helps get money as well.

yup thats them… they get a two line mention in rocksound too…If you have any common sense dont go near the cd.They had to drop some of the songs cos the new guy couldnt do the beats (teethgrinder style double snare, hahaha, and they hated T? too how ironic).Also that guy left the band 2months after they recorded for the same reasons i did… the too many egos…

Yes it is still illegal, MP3 is now seen as a format, like cd or vinyl. So you downloading it is like stealing the cd from a shop to replace your vinyl, in the eyes of the law. The person who uploaded it would be in more trouble but you still have the potenial.

I hope I never get raided by the cops, I found like 300 or so copied cds the other day that Id forgotten about.But I hadnt put any names on them so I had to sit and sift through them to see if they were worth keeping… man that was a hard day at work,,,,( hahahha)
